PFL FAQs
Find answers to some of the most common questions about PFLs. Click on any question below to view the answer.
1. How much time do I have to respond to a Procedural Fairness Letter from IRCC? The deadline for responding to a Procedural Fairness Letter (PFL) is specified in the letter itself and varies depending on the circumstances of your case. In some situations, IRCC may allow only a few days to respond, while in others you may have several weeks. Because the deadline is often short, it is important to begin preparing your response immediately. Waiting until the last few days may leave insufficient time to gather supporting documents or prepare a comprehensive submission. Missing the deadline may result in IRCC making a decision based only on the information already available in your file.
2. Can I ask IRCC for an extension to respond to a Procedural Fairness Letter? Yes, in some situations. If you genuinely require additional time—for example, to obtain documents from another country, receive certified translations, or gather evidence that is not immediately available—you may request an extension before your deadline expires. However, IRCC is not obligated to grant an extension. Your request should explain why additional time is required and, whenever possible, include evidence supporting your request. Even if you request an extension, you should continue preparing your response in case the request is denied.
3. What happens if I ignore a Procedural Fairness Letter? Ignoring a Procedural Fairness Letter is one of the most serious mistakes an applicant can make. If you do not respond before the deadline, IRCC will generally proceed to make a decision based on the information already available in your application. If the officer's concerns remain unanswered, your application may be refused. A Procedural Fairness Letter gives you an opportunity to explain your situation before a final decision is made. Failing to respond means losing that opportunity.
4. Should I respond to a Procedural Fairness Letter myself or hire an RCIC? You are legally permitted to respond on your own. However, many Procedural Fairness Letters involve allegations of misrepresentation, credibility concerns, inadmissibility issues, or complex factual situations. An effective response requires more than simply submitting additional documents—it should directly address every concern raised by the immigration officer and explain why the application should continue to be approved. Professional representation can help ensure that your response is organized, legally sound, and supported by the strongest available evidence.
5. What documents should I include with my Procedural Fairness Letter response? The documents you submit should directly address the concerns raised by IRCC. Depending on your circumstances, supporting evidence may include: Employment records Bank statements Tax documents Educational records Relationship evidence Affidavits or statutory declarations Expert opinions Identity documents Previous immigration records Any other documents that help explain or clarify the officer's concerns Submitting large volumes of unrelated documents is generally less effective than providing well-organized evidence that specifically addresses each issue identified in the Procedural Fairness Letter.
6. Can I submit new evidence that was not included in my original application? Yes. A Procedural Fairness Letter is your opportunity to provide additional information and evidence that addresses the officer's concerns. In many cases, applicants submit documents that were unavailable at the time of the original application or provide evidence to clarify issues that were misunderstood. The additional evidence should be relevant, credible, and directly related to the concerns identified by IRCC.
7. What makes a strong Procedural Fairness Letter response? An effective response should: Address every concern raised by IRCC Explain any inconsistencies clearly and honestly Include relevant supporting evidence Maintain consistency with previous immigration applications Be organized, professional, and easy to follow Be submitted before the deadline Simply denying the officer's concerns without evidence is rarely persuasive. A strong response combines clear explanations with objective supporting documentation.
8. Can I receive a Procedural Fairness Letter because of alleged misrepresentation? Yes. Misrepresentation is one of the most common reasons IRCC issues a Procedural Fairness Letter. Examples include: Omitting previous visa refusals Incorrect employment information False educational documents Undisclosed family members Inconsistent information between applications Documents that IRCC believes are not genuine Because findings of misrepresentation may have serious immigration consequences, these allegations should be addressed carefully and thoroughly.
9. Should I order my GCMS Notes before responding to a Procedural Fairness Letter? It depends. GCMS Notes can provide valuable insight into the immigration officer's concerns and reasoning. However, because Procedural Fairness Letters usually have strict response deadlines, waiting for GCMS Notes is not always practical. The decision should depend on the complexity of your case, the deadline provided by IRCC, and whether the Procedural Fairness Letter already contains enough information to prepare a complete response.
10. What happens after I submit my Procedural Fairness Letter response? After receiving your response, IRCC will review your explanations and supporting evidence before making a decision. Depending on the circumstances, the officer may: Continue processing your application Request additional information Schedule an interview Issue another procedural request Refuse the application if the concerns remain unresolved The quality of your response can significantly influence the outcome of your application.
